Waste created as a by-product of your business is classed as commercial waste. You are legally bound to put in place reasonable procedures to ensure your company diverts as much waste as possible from landfill.

This starts with reducing the amount of waste you produce as much as possible, re-using any of the waste you do produce, and finally recycling anything you cannot reuse. This is commonly known as the 'Three R's', in the waste disposal industry this is called 'The Waste Heirarchy'.

If you are sending your commercial waste to landfill or residential recycling centres you are breaking the law. It is your responsibility to ensure you use a licensed waste management company to dispose of your waste, and that you can provide 'Waste transfer Notes' for everything you dispose of.

Businesses who do not make these necessary provisions and breach their waste management duty of care may be committing an offence under Section 34 of the Environmental Protection Act 1990. The maximum penalty for this conviction in a magistrates' court is £5,000 or an unlimited fine upon conviction at a crown court.
